Dear Sir,

Sub: Implementation of recommendations of 6th CPC – merger of grades – revised classification and mode of filling up of non-gazetted posts – scheme for filling up of vacancies after 31/12/2013.

Ref: (i) Railway Board’s letter No. E(NG)I-2008/PM1/15 dated 03/09/2009, extended upto 31/12/2014 vide Board’s letter dated 16/06/2014.
(ii) Railway Board’s letter No. E(NG)l-2008PM1/15 dated 07/08/2014.
(iii) GS/NFIR’s letter No.II/Pt. 5 dated 08/09/2014.

Federation desires to invite kind attention of the Railway Board to letter dated 03/09/2009, referred to above, wherein it was decided that promotion to all vacancies as existed on 31/08/2009 should be granted as indicated in the enclosure to the said letter. In para 3 of the said letter, it has further been mentioned that the scheme for filling up vacancies arising on or after 01/09/2009 will be issued in due course in consultation with the Federations. Currency of these instructions has been extended by the Railway Board from time to time, the latest extension covers vacancies upto 31/12/2014 vide Board’s letter dated 16/06/2014.

2. NFIR vide letter No.II/6/Pt. 5 dated 08/09/2014 has conveyed protest against arbitrary decision of Railway Board (Board’s letter dated 07/08/2014) to calculate DR, LDCE quota etc., in the merged grades based on Board’s letter dated 03/09/2009. The Federation has also highlighted the harm being done to staff pointing out the case of Technical Supervisors
belonging to JE, SSE.

3. Further to above NFIR wishes to state that the Federation has been receiving grievances from ministerial staff as well whose promotional avenues have also been effected adversely as can be seen from the following position:

It can be seen that 20% quota vacancies against LDCE quota in the category of OS/GP 4200 have wrongly been enhanced to 20% of total of V CPC pay scale posts which is improper.

The percentage needs to be brought down to 10%. NFIR, therefore, once again requests the Railway Board to review and withdraw the instructions issued vide Board’s letter dated 07/08/2014 and hold discussions with the Federation.

Sub: Recruitment to non-gazetted posts on the railways – Adherence to prescribed qualification in recruitment from open market regarding.

Attention is invited to instructions contained in Board’s letter of even number dated 29/6/2006 which debar acceptance of allied/related qualification in lieu of the qualification prescribed by this Ministry and stipulates that candidate in possession of the qualification possessed in line with the extant instructions may only be considered for employment on the railways.

The above instructions were issued to streamline the already perturbed system of open market recruitment, wherein, candidates with similar qualification were being treated differently by different recruiting agencies leading to the matter open for litigation.

However, over a period of time it has been observed that recruiting agencies are seeking clarification from this Ministry on following accounts

(i) recognition of institutions;
(ii) recognition of courses from regulatory bodies, if any, or other nodal bodies;
(iii) whether the course is offered through regular/part-time/distance learning/Membership of Association;
(iv) duration of course; and
(v) Equivalence.

Referring each and every issue to the nodal Departments/Ministries results in inordinate delay in finalizing candidature of candidates which further results in more complications viz. expiry of panels, candidates taking legal recourse etc.

Taking above things into consideration, instructions contained in letter dated 29/6/2006 ibid have been reviewed and it has been decided by the Board that empanelled candidates in possession of prescribed qualification from institutions run by Central Government/State Government/Bodies enacted by Act of Parliament or State Legislatures or recognized by Central Government/State GovernmentIBodies enacted by Act of Parliament or State Legislatures be allowed to join without further going into the issue of recognition. Validity or otherwise, of such recognition, if required, will be confirmed by the concerned recruiting agency, contacting directly to the BoardlUniversity or the Council as the case may be.

These guidelines do not affect in any way the instructions circulated vide letter No.E(NG)II12010IRR-l/17 dated 08/12/2011.

Cases decided otherwise in the past need not be re-opened.

Qualifications awarded by various Boards of School Education in India for the purpose of employment in Railways

Acceptance of certificates/qualifications awarded by various Boards of School Education in India for the purpose of employment on the railways.

Clarification has been received from nodal Ministry/Department of Government of India, viz, Department of Personnel & Training (DOP&T) and M/o Human Resource Development (MHRD) stating that COBSE (Council of Board of School Education in India), an Association of National & State School Boards, is responsible for verifying genuineness/ recognition of School Education Boards in India. It grants membership to Boards/Institutes that are set up by an Act of Parliament or State Legislature or an executive order of the Central/State Governments and follow National Curriculum Framework.

The certificates issued by its member Boards are equivalent to any other board across the country. Accordingly, the matter has been examined and it has been decided by the Board that zonal railways need not approach this Ministry seeking such clarification regarding acceptance or otherwise of certificates/qualification obtained from various Boards of School Education in India and instead, refer to official website of COBSE i.e. www.cobse.org which contain list of Boards of School Education which are Member Boards of COBSE.

Thus certificates/ qualification obtained from all such institutions borne on the aforesaid list will be acceptable for the purpose of employment on the railways, from the date on which the said institution has been accorded membership by COBSE, if they were not recognized earlier by any competent authority. This date of acceptability of certificate may be obtained by approaching COBSE directly and a copy of clarification thus obtained may also be endorsed to this Ministry for information & record.

AIRF urged to Railway Borad to stop recoveries from the employees, due to messy implementation of 2nd & 3rd upgradation under MACP Scheme…

AIRF writes to Railway Board regarding to deny to eligible employees granting of 2nd & 3rd upgradation under MACP Scheme in Railways with appropirate orders and illustrations.

He said in the letter, “The Board are therefore, requested to further look into the matter in totality, as this would undo the provision already made vide Railway Board’s letter dated 10/6/2009 & 29/12/2011, resulting in a lot of recoveries from the staff in case of whom the MACPS has been implemented in terms of Railway Board’s letter under reference at S.No-1.

This issue may be discussed with AIRF threadbare, so that there is no contradiction creating confusion in implementation of MACPS prevailed over Indian Railways and recoveries, if any being initiated on this account in any Zonal Railway, may be stopped till finalization of this issue.
